Why Fencing Regulations Matter

You might be wondering why Virginia Beach has specific regulations for fences. Well, these rules serve several important purposes:

  1. Ensuring public safety
  2. Maintaining neighborhood aesthetics
  3. Preventing disputes between neighbors
  4. Protecting property values
  5. Safeguarding environmental concerns, especially in coastal areas

By understanding and following these regulations, you’re not just complying with the law – you’re also being a good neighbor and contributing to the overall well-being of your community.

Virginia Beach Fencing Regulations: What You Need to Know

Fencing Regulations

In July of 2023, Virginia Beach fencing regulations were updated with the goal of simplifying the process for homeowners and contractors alike. Let’s break it down:

When You Don’t Need A Fence Permit

You no longer need a permit for fences that meet ALL of the following criteria:

  1. Located in a residential zoning district
  2. Accessory to a single-family residence
  3. On an interior lot
  4. No closer than 30 feet to a right-of-way (ROW)
  5. No taller than 4 feet in the front yard and 8 feet in any other yard

If your fence meets all these criteria, you can proceed with installation without obtaining a permit. However, it’s still important to follow all other relevant regulations and guidelines. See diagram below from VA Beach's Department of Planning & Community Development.

When You Need a Fence Permit

You’ll need to obtain a fence permit if your fence:

  1. Doesn’t meet all of the above criteria
  2. Encloses a pool (we’ll get to this later on in this post)
  3. Is located in an easement

The Permit Process

If you determine that you need a fence permit, here’s what you need to know:

Who Can Obtain a Fence Permit?

Either the property owner or the contractor can obtain the permit. However, if a contractor is involved, it’s recommended that they get the permit. Remember, whoever signs for the permit is responsible for the work. Here at Hurricane Fence, we take care of obtaining permits for you.

What Do You Need for a Fence Permit?

To apply for a fence permit, you’ll need:

  1. A copy of a physical survey or site plan drawn to scale
  2. The fence details indicated on the plan, including height and any required landscaping
  3. A list of fence materials

Cost of a Fence Permit

As of the time of this writing, October 2024, a fence permit in Virginia Beach costs $61.

Additional Considerations

  1. Underground Utilities

Before you start digging, it’s crucial to check for underground utility cables. Hurricane Fence will take care of getting your property marked for public utilities, but if doing this yourself, you can complete this part of the process by contacting Virginia 811.

  1. Easements & HOA Approval

Some easements may require permission from your homeowner's association or utility company before you can start work. Always check these requirements before proceeding with your fencing project.

  1. Zoning Ordinance Regulations

The City's Zoning Ordinance regulates various aspects of fencing, including:

  • Location
  • Height
  • Planting requirements
  • Other fencing provisions

Make sure your fence design complies with these regulations, even if you don't need a permit.

  1. Pool Fencing Requirements

If you're installing a fence around a pool, additional regulations apply. Pool fences require a building permit and must meet specific safety standards. Some key requirements include:

  • Minimum height of 4 feet
  • Self-closing and self-latching gates
  • No gaps larger than 4 inches
